By accessing or using InMemory ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
InMemory is a platform for creating, managing, and sharing online memorial pages. The Service allows users to create memorials, upload photos and stories, invite collaborators, and receive tributes and memories from visitors.
3. Accounts
You must create an account to manage memorials. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account.
4. User Content
You retain ownership of all content you upload to the Service, including photos, stories, and biographical information. By uploading content, you grant InMemory a non-exclusive license to host, display, and distribute that content solely for the purpose of operating the Service.
You are responsible for ensuring you have the rights to upload any content and that the content does not violate any third-party rights or applicable laws.
5. Acceptable Use
You agree not to:
- Create memorials for living persons without their consent
- Upload content that is defamatory, abusive, harassing, or otherwise objectionable
- Use the Service for commercial advertising or spam
- Attempt to gain unauthorized access to other users' accounts or data
- Use the Service in any way that could damage, disable, or impair the platform
6. Moderation
Memorial owners and collaborators are responsible for moderating visitor-submitted content on their memorials. InMemory reserves the right to remove content that violates these terms or applicable laws, and to suspend or terminate accounts for repeated violations.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Termination
You may delete your account at any time. InMemory reserves the right to suspend or terminate accounts that violate these Terms. Upon deletion, your memorial data will be permanently removed after a 30-day grace period.
9. Limitation of Liability
The Service is provided "as is" without warranties of any kind. InMemory shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
10. Changes to Terms
We may modify these Terms from time to time. We will notify registered users of significant changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
